Welcome to Buy Poppers Net. These terms and conditions set out the rules and regulations for the use of the Buy Poppers Net website. We ask that you carefully read the General Terms and Conditions, our Cookie Policy and our Privacy Policy, as these govern your access to and use of this site. 

Both the use and sales made through the online store www.buypoppersnet.com imply the Customer's acceptance of the Terms and Conditions, our Cookie Policy and our Privacy Policy which are established in compliance with the applicable legislation.

These Terms and Conditions may be modified. It is the Customer's responsibility to read them periodically, and the conditions in force at the time of the conclusion of the sale or use of the Website shall apply. 

Buy Poppers Net cannot be held responsible for any events resulting from the unavailability of the Site, whatever the duration of such unavailability, and also reserves the right to restrict access to certain areas of the Site for technical reasons or to comply with legal obligations. 1.Parties involved

1.1. The sale of products through the website www.buypoppersnet.com is carried out by PEBBLES AND TALES, LDA, (hereinafter "the Seller") a limited company with Tax Identification Number (NIPC) 516651811 and registered office at Rua Encosta de Gaião, Lot 13B, 4705-828 Braga-Portugal for the marketing of goods and services to consumers over 18 years of age.

1.2. These Online Conditions regulate the purchase of products on www.buypoppersnet.com (hereinafter the "Site"), but do not regulate the sale of products or services by entities other than the Seller and which may be present on the Site through links, advertising banners or other hypertext links. The Seller is not responsible for the supply of goods and services by third parties.

1.3. Information or personal data provided will be treated in accordance with our Privacy Policy. By using this site, you agree to the processing of information and data and declare that all information and data provided are true and accurate.

1.4. The Customer shall be identified through the data provided in the Order. It is forbidden to provide false and/or invented data: the Seller is exempt from any liability in this respect.

2. Scope of the contract

2.1 The information referred to in these online General Terms and Conditions and the data contained on the Website do not constitute an offer to the public, but an invitation to place an Order. After sending the Order Proposal, the Customer will receive an e-mail confirming receipt (hereinafter referred to as "Order Confirmation"). This email does not constitute acceptance of the Order, which shall only be deemed accepted when the Customer receives an email confirming that the Order has been accepted and that the Payment has been accepted (hereinafter, "Accepted Payment").

Therefore, no contract exists between the Customer and the Seller until the Order Proposal is expressly accepted by the Seller by sending the Order and the Shipping Confirmation.

Therefore, the online purchase contract (hereinafter referred to as the "Contract") shall only be deemed concluded when the Customer receives the Order and Shipping Confirmation (hereinafter referred to as the "Shipment"): from that moment onwards, the Order Proposal shall be simply defined as the "Order".

3. Price

3.1. The prices listed in the catalog of this website are applicable in relation to the day of the order. These prices include VAT at the legal rate in force and may vary from one country to another, excluding transport, and may be changed without notice. 

3.2 Despite all efforts, it is possible that the price of some products on the Website may be erroneously indicated as different from the actual price. It is the Seller's responsibility to check the accuracy of the Prices before sending the Order Confirmation and Shipment. If, due to technical errors, material mistakes or other unforeseen circumstances, the Price indicated on the Site is lower than the correct selling price of the Product, the Customer will be contacted to confirm whether it wishes to proceed with the purchase of the Product at the correct price. If the Customer does not wish to proceed with the purchase, the Order Proposal will be cancelled. If the price indicated on the Site is higher than the correct selling price of the Product, the lower price will be charged.

3.3 Payments are always made in Euros, even when prices are indicated in other currencies. Some banks may charge exchange rates. Buy Poppers Net is completely unaware of this fact and assumes no responsibility in this regard.

4. Methods of Payment

4.1. Credit/Debit Card (Visa, Eurocard/Mastercard, Amex): The Customer may use this method, taking advantage of the liquidity benefits and payment terms offered by his bank. After completing the order, an external page, provided by a secure and certified payment organization, will be generated for you to enter your card details. All personal information provided is encrypted to prevent abuse. An SSL connection is activated for each transaction. SSL is a process that encrypts data so that it cannot be read by unauthorized persons during a transaction.

4.2. Payment by bank transfer: Once the order process is completed, you will receive the bank details corresponding to the payment. You can make the payment through your Homebanking or through the ATM network. At an ATM you will only need to enter your card and your code, select the "Transfers" option and execute the transaction. When performing the ATM transaction you must enter the NIB and refer to the order data, so that it is possible to identify the payment. Your order will be sent as soon as the bank confirms the payment. The time it takes to receive confirmation of the payment order may vary, depending on the buyer's bank.

4.3. Payment by Bitcoin: When you finalize your order, you will be able to select the Bitcoin payment method. A page will be generated with a QRCode, a payment reference and the €/Bitcoin conversion. Go to the cryptocurrency application and follow the procedures. You will have 10 minutes to complete the payment. It is highly recommended to indicate the order reference in the remarks of the bank transfer and to send a proof of the transfer to our customer service department to facilitate the identification of the payment and to proceed with the shipment of the order. Any additional fees charged by the bank will be charged to the customer. 

4.4. Buy Poppers Net uses one of the most secure Internet shopping systems and makes a constant effort to improve its software in order to be able to offer the highest possible level of security to its customers.

We use a server certificate, also known as a digital certificate, which guarantees our identity, as well as the SSL (Secure Sockets Layer) protocol for encryption of transmitted data.

 5. Orders and Shipments

5.1. The ordered products are shipped in a discreet package, without any reference to the site and its contents, containing only as sender the name of the company that manages the distribution and address.

5.2 The purchase invoice for the order will be made available together with the shipment of the goods. Upon request by e-mail, the invoice can also be sent in digital format.

5.3 In case of shortage of stock of one or more products, the Customer will be contacted in advance by our company to inform him and offer him a solution as soon as possible:

If the chosen method of payment is cash on delivery, we will take the liberty to remove it from the order and proceed with the shipment of the remaining products in order not to delay the process. In the case of one or more products that are part of a pack, the whole pack will be removed from the order. The Customer will always be informed of the change made.

If the order has been paid with the other available payment methods, we will take the liberty to remove it from the order and the customer service team will contact you. There will be the possibility to replace the missing product with another of equal value, be reimbursed by the same payment method, or choose to benefit from a discount coupon, with the value of the missing product. The Customer will be informed by the Customer Service team, by sending a message, of the alteration of the order or of the refund coupon code.

5.4 The order will be shipped the same day, if the payment is made until 15:00 hours (Portugal) of the same working day. Orders paid after that time, will be shipped, foreseeably, the next business day. This rule applies to any payment method, except when the payment method is bank transfer.

5.5. Shipments are made by Post Office, Nacex, MRW, TNT or DPD. The delivery time depends on the destination. The Seller reserves the right to change the Carrier selected by the Customer, if operational conditions so require.

5.7 Delivery time of the orders: 

5.7.1. ITALY.

Italy: Orders for Italy can be shipped by DPD or TNT with a delivery time of 2-4 working days or by Post Office with a delivery time of 3-6 working days.

5.7.2. INTERNATIONAL SHIPMENTS

Within the European Union, deliveries are made by DPD or TNT within 2-4 working days and by Post Office within 3-6 working days. Deliveries outside the European Union are made only by the Post Office, with an estimated delivery time of 6 to 15 days.

Products shipped may be subject to customs inspection and may be held at customs for as long as the local authorities deem necessary before being released. This means that Buy Poppers Net cannot guarantee a delivery time. The customs clearance of the customer's order may involve the submission of additional documentation and/or the payment of additional customs fees. Buy Poppers Net is not responsible in any of these situations.

ATTENTION: Delivery times are indicative and are therefore only considered valid when there are no physical or structural impediments (e.g. incorrect addresses or force majeure events such as strikes, loss of connection, bad weather, etc.).

5.8. Buy Poppers Net will not be responsible for any customs or other costs that are not directly attributable to Buy Poppers Net, please check the legality of the importation of the items in your country. We will not be responsible for any customs holds.

5.9.The delivery of orders is made from Monday to Friday, except national or local holidays, at the delivery address that the customer has indicated at the time of placing the order.

WARNING: The customer cannot choose a specific delivery time, as deliveries are conditioned by the routes defined by the carrier on the corresponding delivery date.

5.10. Indicating an incorrect or incomplete address may result in the package being returned to Buy Poppers Net, causing additional costs to be borne by the customer. Therefore, we recommend that the customer always ensures that the delivery address provided when placing the order is complete and accurate. Once the order is processed, it is no longer possible to change either the delivery address or the billing information.

5.11. Once the order is shipped, the customer will receive a confirmation email with a tracking number and a link that allows you to track the order on the website of the carrier or through this website: https://www.aftership.com/pt/track . It is possible that, at the time the shipment confirmation with the corresponding tracking number is sent to the customer, no result will be obtained when trying to track the order on the Internet. Updated order tracking information on the carrier's website may take up to 24 hours after receipt of the shipment confirmation email to be available.

5.12. In the event that the customer is not present at the time of delivery at the indicated address, the procedure will be as follows: the carrier will leave a notice for the recipient to call directly to the agency responsible for the delivery of the order or to the order number so that a new delivery date for the order can be set. The recipient has a period of 5 working days to contact the shipping company to arrange a new delivery. In case of failure to contact within the stipulated period, the order will be returned to Buy Poppers Net.

6. Exchanges, Returns and Cancellations

6.1 The right to exchange or return only occurs if the products have not been used, washed or damaged:

It is mandatory to send the equipment in the original packaging.

The original packaging must not be damaged.

Assemblies consisting of several parts must be returned with the complete assembly.

Products must be accompanied by the identification label (if available) and must not have been tampered with.

All items manufactured with customization are not subject to return.

6.2 To exercise your right of return, you must contact our Customer Service, specifying the order number, description or reference of the product(s) you wish to return.

6.3 If you wish to return or exchange one or more items, you may do so within 15 days of receipt of the order, with the guarantee that they will arrive at our premises within 28 days of delivery. To do so, you must send the items to the address indicated in 14.Contacts (14.Contacts). 

6.4 Items must be returned by registered post in a rigid box, accompanied by the invoice or purchase order. We will not accept returns of items in padded envelopes. The Customer must also take into account if the product to be returned was purchased as part of a promotional campaign and if, for that reason, he/she has benefited from a free gift product. In this case, the Customer must return not only the product in question, but also the offer that was delivered with the purchase. Both products must comply with the aforementioned guidelines.

6.5 Incomplete, damaged or scratched products, as well as products without their original packaging and/or label, or with signs of having been used, will not be accepted for return. Products with an expiration date of less than one month will not be accepted. If the Carrier's label is attached directly to the package, the Customer will lose the right to be reimbursed. In case of non-acceptance, the Customer will have 10 days to pick up the item(s) at our facilities, at the Customer's expense.

6.6 The return of the products offered must be made by the person who offered/purchased them, presenting the original invoice. If the defect or non-conformity is confirmed as the reason for the return, the Customer will be reimbursed. The right to return the products only occurs if they are in the conditions mentioned in point 6.1.

6.7 In case of returns of defective products, whenever possible, the products will be exchanged for the same item. Where this is not possible, the Customer will be reimbursed the full value of the defective products, less the value of the shipping costs. 

6.8 In the event that an order is not delivered for reasons not attributable to the Seller or the Customer, regardless of the method of payment chosen, the Customer must submit a written claim to the Carrier which will be reviewed at a later date. Alternatively, and always under the prior express consent of the Customer to do so, the claim submitted by the Customer to Buy Poppers Net may be forwarded to the Carrier in support of the incidence created by the non-delivery.

6.9. In the event that an order has not been delivered, for reasons attributable to the Seller and the Carrier, and has not been picked up at the collection points within the time limit, the order will be returned to the Seller's warehouse. In these cases, the Customer may choose to:

Receive a voucher, with the value of the products, without the value of the shipping or with the shipping discount, in case the shipping was free of charge.

Be reimbursed with the value of the items, deducting the value of the shipping in duplicate.

Obtain a reshipment of the products, applying the payment to the new shipment, which can be done through a payment link, debit card or bank transfer.

6.10. To make an Exchange, the Customer must proceed as a Return and send the order to our facilities. If the returned product is in the conditions mentioned in point 6.1, a coupon of the same value will be granted to make the new purchase.

6.11. You may cancel your order free of charge if it has not yet been paid for and is not being processed. If so, you will only have to send us an email to [email protected] informing us of the order number and indicating that you wish to cancel it. Cancellation of orders is only possible through the process mentioned above. We will not be able to respond to any request made by any other means. If the cancelled order has already been paid by credit/debit card, the value of the order will be refunded minus 10%, due to bank charges.

7. Refunds

7.1 In the event that a refund is applied, the Customer may choose to be refunded via the original payment method/bank transfer (depending on the payment method used) or via a refund voucher which can be used on a future order. The coupon will be valid for 12 months from the date of its creation. After this period, there will be no refund.

  • If the payment has been made by credit card, the refund will be made on the credit card itself and will appear on the next credit card statement.

  • If the payment has been made by bank transfer, the customer will have to send his bank details, and the refund will be credited to the corresponding account and will be available immediately.

  • If the payment has been made through the BITCOIN method, the Customer will be asked to provide us with the details of the account to which he/she wishes the refund amount to be made.

7.2 The reimbursement of the shipping costs of an order may occur in the following situations:

  • Non-delivery of the order for reasons attributable to Buy Poppers Net or the carrier: the customer will be fully refunded the amount paid for shipping costs. 

  • Error in the products shipped: the customer will be fully reimbursed for the amount he/she may have paid for the shipping costs only if the error occurs in all the products shipped. 

8. Warranty

8.1. One of the basic rights of consumers is the access to services and goods that correspond to those purchased and that they have a guarantee of proper functioning. Therefore, Buy Poppers Net guarantees the quality of its products for a period of 24 months from the date of purchase (except for perishable products), offering its customers, whenever legitimate, one of the following solutions:

Repair of the damaged item, guaranteeing its proper functioning and/or final quality;

Exchange for an identical product;

Exchange for a product with similar characteristics and purpose with the customer's consent;

Dissolution of the contract, which entails reimbursement, in case the previous options are not possible.

8.2. In order to exercise its right of warranty, it will be necessary for the customer to file a complaint about our services through the means set out in the terms and conditions of sale, and return the defective product or product that does not correspond to the purchased item. Our customer service team will analyze the corresponding item to check the validity of the warranty of the item being claimed by the customer. Claims arising from situations including, but not limited to, the following will not be accepted:

Misuse and intentional or unintentional damage by the customer;

Normal wear and tear of the product, as long as it is within the acceptable levels declared by the manufacturer;

Inability to confirm the malfunction or defect described by the customer;

All situations identified as attempted fraud.

 

8.3. After having inspected the returned product, the customer will be informed of the decision regarding his claim. In cases where the exercise of the warranty is applicable, Buy Poppers Net will promote the repair or replacement of the item or the refund of the corresponding payment, in the shortest possible time, up to a maximum of 30 days from the day of the written confirmation indicating that the customer is entitled to exercise the right of warranty.

8.4. The reimbursement of any amount shall be made through the original form of payment, unless a different agreement is reached with the customer.

These provisions do not affect the customer's statutory rights.

9. Additional Information

9.1. Claims for defective poppers must be made on the same day the customer receives the package. The claim must be made to [email protected] with the sending of photos to be registered.

10. Suggestions and Complaints

10.1 Customer feedback is very important to Buy Poppers Net, as it allows us to implement and improve the services provided. Therefore, if for any reason the Customer is not satisfied with them or has any suggestions, please take a few minutes of your time and let us know by sending a message to the Customer Care team.

10.2 If the complaint concerns a specific order, the Customer has 15 days from receipt of the order to contact our Customer Service team and notify us of the problem.

10.3 If you have received a defective or damaged product, or if the product you have received is different from the one you actually ordered, you must attach to your complaint a video or photographs clearly showing both the problems detected and the condition of the box in which the order was delivered.

10.4 In addition, the Customer must keep both the defective/damaged/changed product and the order box in his possession until the Customer Service team instructs him otherwise.

10.5 If at the time of delivery of the order, the external condition of the box is not in perfect condition, the Customer must refuse delivery at the risk of the claim not being accepted.

11. Leather Cleaners - Information

11.1. All liquid scents (known as poppers) that we sell in our online store are specifically designed and manufactured for the cleaning and conditioning of Erotic Leather Garments and Erotic Leather Toys and accessories. Leather Cleaners are not manufactured or used for human consumption. These scents are produced according to European standards and therefore we guarantee their purity and safety. However, we distance ourselves from the abuse of our products as aphrodisiacs or products for sexual stimulation and any other inappropriate handling. All liquid scents offered in our store cannot be inhaled directly from the bottle.

11.2. Although the use of liquid scents is legal in many countries, there may be trade restrictions in some states. Due to different national legislations you may not be allowed to import some of the products offered in your country. It is your responsibility to find out about this before placing an order. Please check the local laws of your country before purchasing and importing.

11.3. By placing an order you confirm that you are at least 18 years of age. You are aware of the use and side effects of the product, and before purchasing the product you have informed yourself adequately. You have carefully read our General Terms and Conditions and agree to them. You hereby release Pebbles and Tales, its employees, suppliers and all associated persons from any liability for damages resulting from the misuse of our goods. All our products are shipped from the European Union.

12. Right of withdrawal

12.1 In accordance with Decree Law 24/2014 of 14 February, the consumer has 15 days after receipt of the goods to withdraw from the contract and return them. To do so, the consumer has to communicate to Buy Poppers Net, the decision to withdraw from the contract by an unequivocal statement (e.g. letter sent by mail, fax or email, in the latter case to the email address [email protected] or by using the form available here 

12.2 The right of withdrawal free of charge must be exercised by sending the communication mentioned in the previous paragraph within 15 days. The consumer is solely responsible for proving that he/she has exercised the right of withdrawal free of charge within the legal deadline. 11.3.

12.3 The consumer must, within fifteen days from the day on which it communicates its decision to withdraw from the contract, return the goods to the establishment where they were purchased. In case of withdrawal, the consumer shall be solely responsible for the cost of returning the goods.

12.4 In case of withdrawal from this contract, all payments made (with the exception of the additional costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us) will be refunded without undue delay and in any case.

12.5 Buy Poppers Net, may withhold reimbursement until receipt of the goods or until the consumer has provided irrefutable proof that the goods have been returned.

12.6 Failure to comply with the obligation to reimburse within 15 days from the date of receipt of the withdrawal will result in a double refund, without prejudice to the consumer's right to compensation for damages.

12.7 The consumer must keep the goods in such a way that he can return them in proper conditions of use. The exercise of the right of withdrawal is without prejudice to the consumer's right to inspect the nature, characteristics and functioning of the goods with due care. 11.8.

12.8 The consumer is liable for the diminished value of the good if the handling carried out to inspect the nature, characteristics and functioning of the good exceeds the handling normally permitted in stores.

12.9 With the exercise of the right of withdrawal, the consumer will be refunded the price paid minus the amount corresponding to the depreciation. If the depreciation is total, there will be no refund.

12.10. The right of withdrawal of free will is no longer applicable in the following situations:

  • Supply of sealed non-returnable products for reasons of health protection or hygiene when opened after delivery;

  • Supply of sealed audio or video recordings or sealed software, from which the consumer has removed the tamper-proof seal after delivery;

  • Without prejudice to the exercise of the rights arising from the legal guarantee of consumer goods, the following types of products are excluded from the right of free withdrawal: cosmetic, beauty and personal hygiene products, lingerie, underwear, food supplements, vitamins, products for intimate use. Audio and video recordings, discs and computer programs that have been unsealed by the consumer.

13. Applicable Law, Conflict Resolution and Jurisdiction

13.1 This contract is governed by Portuguese law and, for the resolution of any dispute, the jurisdiction of the District of Braga is competent, renouncing any other.
